Implementing the direction of the Central Inspection Committee, the Ministry of Natural Resources and Environment has directed the People’s Committees of provinces and centrally-run cities to direct the strengthening of land registration and the issuance of land use right certificates.

Implementing the direction of the Ministry of Natural Resources and Environment, in recent days, the People’s Committees of provinces and cities across the country have issued many documents directing the strengthening of land registration and the issuance of land use right certificates.

For example, on April 12, the People’s Committee of Quang Nam province requested the Department of Natural Resources and Environment and the People’s Committees of districts, towns and cities to direct the Land Registration Offices at all levels, the Department of Natural Resources and Environment, the People’s Committees of communes, wards and towns to publicly post the land registration process and procedures, the time to handle administrative procedures on land of relevant departments and to issue Certificates of land use rights, house ownership rights and other assets attached to land (Certificates) in accordance with the provisions of law.

The People’s Committee of Quang Nam province also requested to strengthen the inspection and examination of public service activities, promptly detect and strictly handle organizations and individuals with violations; rectify the working style and attitude of civil servants and public employees performing the task of handling registration procedures and issuing Certificates; especially at the dossier receiving department of the Public Administration Center or the one-stop department and the branches of the Land Registration Office; Do not let officials harass or cause trouble for people and businesses.

If necessary, rotate, transfer, and change work positions in accordance with regulations to strengthen localities with a large workload, while also minimizing possible negative impacts.

On the same day, Khanh Hoa Provincial People’s Committee also requested the Department of Natural Resources and Environment to urgently preside over and coordinate with relevant departments, branches, units and localities to study and advise the Provincial People’s Committee on documents to deploy and develop a plan to strengthen land registration and issuance of land use right certificates as required by the Ministry of Natural Resources and Environment.

Similar to Quang Nam and Khanh Hoa, on April 21, 2023, Lam Dong Provincial People’s Committee also directed the work of land registration and issuance of land use right certificates.

Lam Dong Provincial People’s Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with relevant agencies, units and localities to advise the Provincial People’s Committee on the implementation of the direction of the Ministry of Natural Resources and Environment.

Lam Dong Provincial Department of Natural Resources and Environment is responsible for preparing a report for the Provincial People’s Committee on the implementation plan of the contents as required by the Ministry of Natural Resources and Environment. In which, clearly state the time of completion of the first land registration, to report to the Ministry of Natural Resources and Environment.

What does the Ministry of Natural Resources and Environment direct?

Previously, on April 5, 2023, Mr. Le Minh Ngan – Deputy Minister of Natural Resources and Environment signed Official Dispatch No. 2317/BTNMT-CĐKDLTTĐĐ to the People’s Committees of provinces and centrally run cities to direct the strengthening of land registration and issuance of Certificates in the current situation.

In this Official Dispatch, the Ministry of Natural Resources and Environment stated that land registration, issuance of Certificates of land use rights, Certificates of land use rights, house ownership rights and other assets attached to land are one of the contents of state management of land.

Through land registration, issuance of Land Use Right Certificates, Certificates of Land Use Right, House Ownership Rights and Other Assets Attached to Land (Certificates), the State establishes a complete cadastral record for all land within the scope of each commune-level administrative unit nationwide, as a basis for the State to strictly manage all land in accordance with the provisions of law; eligible land users will be granted Certificates.

Through the issuance of Certificates, land users are confirmed by the State to have legal land use rights, and are allowed to conduct land transactions in accordance with the provisions of law.

Implementing the 2013 Land Law and the Prime Minister’s directives, in the recent past, the Ministry of Natural Resources and Environment has made efforts with localities to implement solutions to promote land registration and issuance of Certificates. Up to now, the issuance of first Certificates has been basically completed nationwide.

However, the implementation of initial land registration has not been thoroughly implemented in some localities, leading to the remaining land area that has not been granted a Certificate or is not eligible for a Certificate being not registered for management.

In addition, the work of registering land changes and granting Certificates in some places is not strictly implemented, and there are still cases of officials harassing and causing trouble for people and businesses.

Implementing the Conclusion Notice No. 410-TB/UBKTTW dated December 30, 2022 of the Central Inspection Committee, to rectify and overcome shortcomings and limitations in land registration and granting Certificates, the Ministry of Natural Resources and Environment requests the People’s Committees of provinces and centrally-run cities to pay attention to and direct the implementation of related contents.

Accordingly, the Ministry of Natural Resources and Environment requires localities to direct the organization of the implementation of initial land registration in accordance with the provisions of law, in which specific responsibilities are assigned to levels, sectors, and each agency and organization for implementation.

The Ministry of Natural Resources and Environment also requires rectification and strict control of the process and time limit for handling administrative procedures on land to ensure clear division of people, responsibilities, work, and processing time.

In particular, strengthening discipline, rectifying working style, attitude, and behavior of civil servants and public employees performing land registration and granting Certificates, especially at the departments that directly contact people and businesses.

In addition, strengthening inspection and examination of public service activities to promptly detect and strictly handle organizations and individuals who violate land laws when performing public duties in accordance with the provisions of law.

If necessary, rotate, transfer, and change work positions in accordance with regulations to minimize possible negative impacts.

The Ministry of Natural Resources and Environment also requires the implementation of surprise inspections of public services, focusing on departments that directly contact people and businesses to promptly detect and strictly handle violations by civil servants and public employees in the performance of public duties according to regulations.

The Ministry of Natural Resources and Environment requests the People’s Committees of provinces and centrally run cities to urgently direct the implementation and report specifically on the implementation plan of the above contents. In which, clearly state the time of completion of the first land registration so that the Ministry can synthesize and report to the Central Inspection Committee.
